Your Access to the official Company Register of the Republic of Austria.

The Company Register is a public directory operated by regional courts (Vienna: commercial court). It is used for recording and disclosure of facts which must be published due to company law.

The Company Register contains the main register with all entries, and the collection of those documents which are the basis to those entries (eg articles of incorporation, annual accounts). Each entity has assigned a unique company register number (Firmenbuchnummer), consisting of numbers and a check letter.

Keeping records of the main register in the central company register database was started in 1991. Annual accounts are available electronically since 2001, documents such as articles of incorporation since mid-2005. Older records may be viewed at the regional courts.

The company register database is operated in the Federal Computing Center (BRZ). The Federal Ministry of Justice has commissioned kompany as official Clearing House to provide access to this database. kompany is official Clearing House since 2012, the license has been renewed for another 3 years in 2015.

Your Access to the official Land Registry of the Republic of Austria.

The Land Registry is a public directory, used for recording of land properties and rights in rem linked to them. The Land Registry is operated by the district courts. The main book (Hauptbuch) contains the registrations, the document collection those documents which are the basis to those entries. Each property has assigned a register number (EZ) and a cadastral municipality (KG).

The entries in the Land Registry inform about the property, residential property, the lien, the construction rights, easements and encumbrances. The plot directory of the cadaster provides information about the plot number, type of use or use sections (construction area, garden etc.) and the extent of the area.

The land registry database can be accessed online since 1991. An estate must be identified unequivocally by the combination of cadastral municipality and register number or plot number. You can also search for addresses. Please note that such searches entail costs - check the List of Fees for details.

Your Access to the official Trade Register (GISA) of the Republic of Austria.

The Austrian Trade Register application (GISA) was created as a nationwide database and has replaced the existing 14 decentralised trade registers in 2015.

The GISA records contain the most important business-related data from all commercial businesses which are established in Austria, in particular company name, name of the proprietor, location, wording of the business license and the date of incorporation of a commercial enterprise. For the data of sole traders that are not registered in the company register, GISA is the only authentic source of information.

The Austrian Trade, Commerce and Industry Regulation Act provides the legal background for commercial activities. This law defines an occupation as commercial it "is carried independently, regularly and with the intention of gaining return or other economic advantage".

Electronic Access to Court Files

The electronic access to court records is provided by the Federal Ministry of Justice as a fee-based online query. Users who have an address code can retrieve data from the electronic case register and lawsuit data of the Austrian jurisdiction. Users are lawyers, notaries and court commissioners, lawsuit types civil proceedings, labour & social court proceedings, executory proceedings and probate matters.

Central Civil Register (ZMR)

The Central Civic Register (ZMR) is the central database of all persons with residence in Austria. Access is regulated in §16a Abs1 and Abs5 Resident Registration Act (MeldeG), and mainly reserved for lawyers and notaries in exercise of their profession.

Web based electronic legal communication (webERV)

The application ERV - legal electronic communication - enables secure paperless transmission of structured, further processable data of parties to the court and back. 95% of summary proceedings are managed via ERV today, the direct submission of documents such as filing of annual accounts in the company register is possible. kompany provides an internet browser-based application, the installation of software is not required.

What information is recorded in the Company Register?

The records inform about the legal form of a company, the establishment, management bodies, the shareholders and their shares, provide information on insolvency proceedings and mergers and generally changes. Retrievable documents include the articles of association, annual accounts, reports and protocols, signature samples and more.

How up to date is the information?

You can be confident that the data you request is always up to date and valid, in accordance with §15 UGB (Commercial Law, Publicity of the Company Register). The central company register database went operational in 1991. Annual accounts are available electronically since 2001, documents such as articles of incorporation since mid-2005. Older records may be viewed at the regional courts.

Is there a limit to the number of queries?

For your safety we have set an account limit of EUR 120 (incl. Clearing House Surcharge and VAT). As soon as you have reached this amount we get in contact with you. We can thus reliably protect you against inadvertently high cost, and you are always up to date with the state of your state of queries.

What fees are charged?

Queries in the Company Register database are chargeable, the official fees are set by law. What is the Austrian Land Registry (Grundbuch)?

A public directory, used for recording of land properties and rights in rem linked to them, whereat those rights are only acquired through registration. The Land Registry is operated by the district courts. The main book (Hauptbuch) contains the registrations, the document collection those documents which are the basis to those entries. Each property has assigned a register number (EZ) and a cadastral municipality (KG).

There are also auxiliary directories. The List of Properties contains the plot numbers for each cadastral municipality, the Address List the property addresses and the Directory of Names or Persons the names and addresses of the registered owners for each Austrian state.

The cadaster is a public facility operated by the cadastral offices, providing insight into circumstances of plots and – as far as a border cadaster has been created - the binding evidence of plot boundaries. The cadaster includes the coordinates for determining the position of fixed points and plot boundaries, plans and aerial photographs, and also the digital cadastral map (drawings of the properties) and the plot directory.

What is the Austrian Trade Register (GISA)?

GISA stands for the new Austrian Trade Register. It was launched as an austrianwide solution in 2015 and replaces the so far 14 decentrally operated registers. With GISA entrepreneurs can now electronically register their trade, change of location, opening of new premises or appoint managing directors under trade law without having to present themselves in person before the authorities. And in GISA data about commercial enterprises can be obtained.

What information is recorded in the Trade Register?

The GISA records contain the most important business-related data from all commercial businesses which are established in Austria, in particular company name, name of the proprietor, location, wording of the business license and the date of incorporation of a commercial enterprise. For the data of sole traders that are not registered in the company register, GISA is the only authentic source of information. Data quality is ensured by standardised matching with other register.

How do I search the Trade Register?

Search for a sole trader by first and family name, a date of birth may help. Look up registered companies by name or registration number, the latter is unique. Please note that the hit list after a successful search is already charge - check the List of Fees for details.
